Judicial Interpretations Issued on Trial Court Cross-Examination Procedures for Government Compensation Cases

The Supreme People's Court recently issued the Trial Court Cross-Examination Procedures for Government Compensation Cases Heard by the Compensation Tribunals of the People's Courts (the "Provisions"), which will go into effect on March 1, 2014.


The Provisions consist of 26 articles covering the entire process for hearing government compensation cases through cross-examination procedures by compensation tribunals, especially where the content of cross-examination is related to the procedures and the rules of evidence. The Provisions are applicable when compensation tribunals hear statements and arguments by claimants and responsible government agencies and then conduct cross-examination under Article 27 of the Government Compensation Law. Cross-examination must be conducted publicly except when it involves government secrets or personal privacy concerns, or where private cross-examination is stipulated by law.
