CTO Commences Using 11th Edition Nice Classification; Amends Distinction Table for Similar Goods and Services
On December 26, 2016, the Trademark Office of the State Administration for Industry and Commerce released a Notice on the Commencement of Use of the 11th Edition Nice Classification. According to the Notice, member countries of the Nice Alliance (including China) will start using the 11th Edition Nice Classification as of January 1, 2017, as required by WIPO. The new edition will apply to trademark applications submitted on or after January 1, 2017, and the old edition will remain applicable to trademark applications filed prior to this date.
The CTO also amended the Distinction Table for Similar Goods and Services accordingly. The amendments affected 42 classes of trademarks but excluded Class 2, Class 23 and Class 38.
