W&B and JETRO Co-Host Lecture on Patent Infringement Litigation Practice
On the morning of September 16, 2015, WB partner Xiaobo He delivered a lecture entitled “Inspiration, Principles and Application of Article II of the Anti-Unfair Competition Law” at the Shanghai International Trade Center. This lecture served as the second session of the IPR Lecture Series for Chinese Employees of Japanese Enterprises that is being co-hosted by W&B and the Shanghai Office of Japan External Trade Organization (“JETRO”). 36 mid-level employees of Japanese enterprises attended the lecture.

Mr. He first cited relevant provisions of the Anti-Unfair Competition Law and introduced the characteristics, legislative spirit and purposes of the law. He then explained the basic legal concept of the law by comparing it with Anti-Monopoly Law and clarifying object of protection of the Anti-Unfair Competition Law.
Mr. He then introduced the issue of why Article II of the Anti-Unfair Competition Law should apply. He emphasized the importance of this issue through case examples and related aspects such as the IPR protection functions and methods of the Anti-Unfair Competition Law. He took a theoretical approach to analyzing the application of Article II by describing the characteristics and key features of its general provisions, illustrating his ideas by citing court precedents from significant cases.

In his summary Mr. He summarized the legal provisions and judicial interpretations that might apply by analyzing and explaining landmark precedents such as the Kelp Quota Case and the inspiration thereof. At the end the lecture Mr. He offered in-house counsels valuable advice on mitigating legal risk based on his own practice experience.
The lecture concluded with enthusiastic applause from the audience. After the lecture, the audience engaged in a Q&A session with Mr. He concerning legal problems they encountered at work.
